This AI Receptionist Service Agreement ("Agreement") is between JellyPickle ("Company") and the customer or business accepting this Agreement ("Customer"). By purchasing, accessing, or using JellyPickle services, Customer agrees to these terms.
1. Service Description
JellyPickle provides automated business communication and automation services. Services may include:
- Automated phone answering
- Customer inquiry handling
- Lead information collection
- Appointment scheduling assistance
- Business information responses
- Call routing
- Communication automation
- Usage reporting and analytics
Features available to Customer depend on the selected subscription plan. JellyPickle may update, improve, modify, or discontinue features as the service develops.
2. Automation Technology Disclaimer
Customer understands that JellyPickle uses automated (artificial intelligence) technology. Automated responses may occasionally be inaccurate, incomplete, outdated, or inappropriate for a specific situation. Customer is responsible for:
- Reviewing business information provided to JellyPickle
- Ensuring instructions to the automated receptionist are accurate
- Monitoring customer interactions when appropriate
- Ensuring the automated receptionist represents the business correctly
JellyPickle does not guarantee that automated responses will always be error-free.
3. No Guarantee of Business Results
JellyPickle provides software and automation tools. JellyPickle does not guarantee increased revenue, increased sales, more customers, more appointments, business growth, or specific financial results. Customer results depend on many factors outside JellyPickle's control.
4. Customer Responsibilities
Customer agrees to provide accurate information necessary for service operation, including business details, hours of operation, services offered, pricing information, and policies provided to the automated receptionist, and to review automated communications. Customer is responsible for ensuring their use of JellyPickle complies with laws and regulations applicable to their business.
5. Industry-Specific Compliance
JellyPickle may be used by businesses in different industries. Customer remains responsible for complying with all laws, regulations, licensing requirements, privacy obligations, and industry standards applicable to their business. Certain industries, features, integrations, or use cases may require additional agreements, verification, security requirements, or compliance steps before being made available, and JellyPickle may restrict access to certain features until applicable requirements are satisfied. JellyPickle does not guarantee that use of the platform alone satisfies any industry's legal or regulatory requirements.
6. Acceptable Use
Customer may not use JellyPickle for illegal activities, fraud, spam, harassment, abuse of communication systems, misrepresentation, or activities violating applicable laws. JellyPickle may suspend service if misuse creates security, legal, or operational risks.
7. Payments and Subscription
Customer agrees to pay applicable subscription fees. Subscriptions automatically renew unless canceled, and Customer authorizes recurring billing. Failure to pay may result in suspension or termination of service. Setup fees, usage fees, or additional charges may apply depending on the selected plan.
8. Cancellation
Customer may cancel according to the cancellation process provided by JellyPickle. Cancellation stops future billing according to the applicable billing cycle. Customer remains responsible for charges incurred before cancellation becomes effective.
9. Third-Party Services
JellyPickle relies on third-party providers, which may include voice providers, technology providers, payment processors, calendar systems, integration providers, and hosting providers. Third-party services may experience outages, changes, or limitations. JellyPickle is not responsible for failures caused by third-party providers.
10. Data and Privacy
JellyPickle may process information necessary to provide services, including business information, customer-provided settings, usage information, and communication data necessary for functionality. Customer remains responsible for having appropriate rights and permissions for information submitted to JellyPickle.
11. Customer Data Ownership
Customer retains ownership of their business information and customer data. JellyPickle receives permission to process Customer data only as necessary to provide and improve the service and does not claim ownership of Customer data.
12. Intellectual Property
JellyPickle retains ownership of its software, platform architecture, automated systems, automation systems, internal tools, and proprietary processes. Customer receives a limited right to use the service while subscribed.
13. Service Availability
JellyPickle will make reasonable efforts to maintain availability. However, uninterrupted service is not guaranteed. Interruptions may occur due to maintenance, updates, security events, technical issues, or third-party outages.
14. Limitation of Liability
To the maximum extent permitted by law, JellyPickle is not responsible for indirect, incidental, special, or consequential damages. JellyPickle's total liability related to the service will not exceed the amount paid by Customer to JellyPickle during the applicable limitation period permitted by law.
15. Automated Communication Responsibility
Customer understands that automated communication requires appropriate oversight. Customer is responsible for reviewing settings, providing accurate information, ensuring industry requirements are followed, and determining whether JellyPickle is appropriate for their business.
16. Changes to Agreement
JellyPickle may update this Agreement as the service evolves. Customers may be required to accept updated terms before continued use.
17. Governing Law
This Agreement is governed by applicable laws of the jurisdiction where JellyPickle operates, unless otherwise required by law.
18. Entire Agreement
This Agreement represents the understanding between JellyPickle and Customer regarding use of the service.
Customer Acceptance
By purchasing, accessing, or using JellyPickle, Customer confirms that they have reviewed this Agreement, understand JellyPickle uses automated technology, and agree to these terms.
